How it got here

The legislative record

  1. 2015

    The Texas Compassionate Use Act (SB 339) creates TCUP and directs DPS to build a registry of prescribing physicians.1

  2. 2019

    HB 1325 legalizes hemp at up to 0.3 percent delta-9 THC by dry weight, opening the state's consumable hemp retail market.10

  3. 2025

    Governor Abbott vetoes SB 3 on June 22, the bill that would have banned consumable hemp THC products at retail.7

    HB 46 takes effect September 1, expanding TCUP conditions, setting a 10 mg per dose cap and authorizing 15 dispensing licenses.8

Texas has no citizen ballot initiative, so change runs through the Legislature, which next convenes January 12, 2027. Sen. Charles Perry has said he will refile a hemp THC ban. Expect the retail market to keep narrowing while TCUP absorbs the demand.

Are there recreational cannabis dispensaries in Austin?

No. The only legal cannabis retail in Austin runs through the Texas Compassionate Use Program, which requires a prescription from a physician registered with the Department of Public Safety. Texas DPS lists Fluent, Texas Original and goodblend as the active licensed dispensing organizations statewide.4

Did Austin legalize marijuana with Proposition A?

No. Austin's 2022 voter-approved initiative directs police not to issue citations or make arrests for Class A or Class B misdemeanor marijuana possession absent an alleged felony narcotics case, and bars no-knock warrants. It is an enforcement policy, not a legalization or retail licensing measure.23

What changed for Austin patients under HB 46?

HB 46 took effect September 1, 2025. It redefined low-THC cannabis as no more than 10 milligrams of THC per dosage unit, added chronic pain, traumatic brain injury, Crohn's disease and hospice or terminal conditions to the qualifying list, and allowed prescribed pulmonary inhalation of aerosol or vapor.22

How many Texas dispensary licenses are coming, and will Austin get more locations?

HB 46 requires DPS to issue 15 dispensing organization licenses total. With three active, DPS opened an application window in August 2025 and stated it would issue nine new licenses by December 1, 2025 and three more by April 1, 2026, ranked partly on public health region priority.20

Where can Austin patients pick up low-THC cannabis?

Licensed operators publish a small set of Austin-area pickup points plus statewide delivery. Texas Original lists a Manchaca address in far South Austin, and goodblend lists an East Riverside Drive site and a North Austin site on Park Bend Drive. HB 46 also authorizes DPS-approved satellite locations.24

Why do Austin cannabis searches surface smoke shops instead of licensed dispensaries?

Because only three licensed dispensing organizations operate statewide while Austin's hemp, vape and smoke shops are far more numerous, generic queries pull the denser local-business set. Fixing it takes explicit entity language, program-name targeting such as Texas Compassionate Use Program, and schema that names the DPS license.4
