The legislative record
2015
The Texas Compassionate Use Act (SB 339) creates TCUP and directs DPS to build a registry of prescribing physicians.1
2019
HB 1325 legalizes hemp at up to 0.3 percent delta-9 THC by dry weight, opening the state's consumable hemp retail market.10

Governor Abbott vetoes SB 3 on June 22, the bill that would have banned consumable hemp THC products at retail.7

HB 46 takes effect September 1, expanding TCUP conditions, setting a 10 mg per dose cap and authorizing 15 dispensing licenses.8

Is there a medical marijuana dispensary in Dallas, Texas?
Texas licenses dispensing organizations statewide rather than city storefronts. The Department of Public Safety lists three active licensees: Fluent, Texas Original and goodblend. They reach Dallas through delivery and pickup points. Texas Original lists Plano and Hurst sites for the metro, and goodblend lists Plano.4
Are new dispensary licenses coming to the Dallas area?
Yes. House Bill 46 raised the cap to 15 licenses. In December 2025 DPS conditionally awarded Texas Patient Access, LLC and Lonestar Compassionate Care Group, LLC in Public Health Region 3, which includes Dallas County. Conditional licenses do not authorize sales until DPS grants final approval.20
Did Dallas decriminalize marijuana under Proposition R?
No, Proposition R never took effect. Dallas voters approved the November 2024 charter amendment limiting police enforcement of low level possession, but a state appeals court held in April 2025 that cities cannot bar enforcement, and Dallas joined the Attorney General in June 2025 seeking an injunction.24
Do Dallas patients need a medical marijuana card?
No. Texas does not issue medical marijuana cards. A physician registered with the Compassionate Use Program enters the prescription into the Compassionate Use Registry of Texas, a secure state database that licensed dispensing organizations and law enforcement use to verify patients, according to the Department of Public Safety.1
Which conditions can a Texas physician prescribe low THC cannabis for in 2026?
House Bill 46, effective September 1, 2025, set the statutory list: epilepsy, seizure disorder, multiple sclerosis, spasticity, ALS, autism, cancer, an incurable neurodegenerative disease, post traumatic stress disorder, a condition that causes chronic pain, traumatic brain injury, Crohn's or other inflammatory bowel disease, and terminal illness or hospice care.21
How large is the Texas patient pool Dallas brands are competing for?
The Department of Public Safety reported 157,586 patients listed in the Compassionate Use Registry in June 2026, a lifetime count since the program began in 2017, up from 138,567 in January 2026. DPS reported 970 approved prescribing physicians statewide that same month.1
