Idaho
cannabis & CBD market
Idaho is a full prohibition state: no medical program, no adult-use market. Since July 1, 2026, HB 879 ties retail hemp products for ingestion or inhalation to Idaho's 0.3 percent total THC definition, while ISDA guidance still states 0 percent at distribution. The legal retail segment is CBD, hemp, smoke and vape shops.
The law, as it stands
Idaho status board
- Legal status
- Full prohibition. No adult-use market and no medical cannabis program. Marijuana and tetrahydrocannabinols are Schedule I substances under Idaho Code 37-2705, and possession, delivery and manufacture are criminalized under Idaho Code 37-2732.1
- What may be sold at retail
- Hemp derived CBD, and other hemp products only if they meet Idaho's hemp definition. Idaho Code 22-1705(4) ties retail products for ingestion or inhalation to the criteria in 37-2701(u), while ISDA guidance still states 0 percent THC at distribution. High THCA flower fails the total THC test, and delta-8 remains exposed under Idaho's Schedule I tetrahydrocannabinols listing.1
- Governing body
- The Idaho State Department of Agriculture regulates hemp. Idaho Code 22-1705(4) now places establishments offering ingestible or inhalable hemp products under Title 22, Chapter 17, and 22-1705(5) authorizes ISDA to set fees and penalties by rule. Idaho has no cannabis regulator because it has no cannabis program.1
- Program
- No state cannabis program. Hemp operates under the Industrial Hemp Research and Development Act, Idaho Code Title 22, Chapter 17.1
- In effect since
- 2021 for industrial hemp, with retail hemp provisions added effective July 1, 20261
- THC rule
- Three layers apply. Handling facilities may obtain hemp from a producer at up to 0.3 percent THC. ISDA guidance states manufactured hemp products must be at 0 percent THC at the point of distribution. Since July 1, 2026, Idaho Code 22-1705(4) requires retail hemp products for ingestion or inhalation to meet 37-2701(u), which sets 0.3 percent total delta-9 THC including THCA.1

Who we grow here
Idaho CBD stores, hemp retailers, smoke shops and vape shops

Legislation watch
Nothing pending would open an Idaho dispensary market. The live questions are HJR 4 on the November 3, 2026 ballot, which would close the citizen initiative route, and how ISDA reconciles its 0 percent guidance with HB 879. The federal hemp redefinition takes effect November 12, 2026.
HJR 4 constitutional amendment
Certified for the November 3, 2026 ballot as the Grant Legislature Exclusive Authority and Prohibit Citizen-Initiated Measures on Marijuana, Narcotics, and Psychoactive Substances Amendment.15
Idaho Medical Cannabis Act and Decriminalize Cannabis Now initiatives
Both are listed by the Secretary of State among the initiatives that did not qualify for the November 3, 2026 ballot.15

Signed April 2, 2026, effective July 1, 2026, Session Law Chapter 292. Passed the House 53-16-1 and the Senate 24-10-1. It added Idaho Code 22-1705(4), requiring such products to meet the criteria of Idaho Code 37-2701(u) and 37-2705(d)(29)(i) and subjecting those establishments to Title 22, Chapter 17.7

Answered on the record
Idaho cannabis questions
Is marijuana legal in Idaho in 2026?
No. Idaho prohibits marijuana for every use, with no medical or adult-use program. Under Idaho Code 37-2732, possessing three ounces or less is a misdemeanor carrying a mandatory minimum fine of 300 dollars for anyone 18 or older, in addition to penalties of up to one year in jail and up to 1,000 dollars.4
Is CBD legal to sell in Idaho?
Yes, within a narrow rule. The Idaho Office of Drug Policy states CBD oil is legal in Idaho only when processed from industrial hemp and containing no THC at all. Since July 1, 2026, Idaho Code 22-1705(4) has tied retail hemp products for ingestion or inhalation to the 0.3 percent total THC definition, so confirm current requirements with ISDA.10
Are delta-8, THCA flower or hemp THC drinks legal in Idaho?
It depends on the product and the standard applied. Idaho Code 22-1705(4) requires retail hemp products for ingestion or inhalation to meet the 0.3 percent total THC definition in 37-2701(u), while ISDA guidance still states 0 percent at distribution. High THCA flower fails that test once decarboxylated, and delta-8 remains exposed under the Schedule I tetrahydrocannabinols listing.1
Did Idaho vote on medical marijuana in 2026?
No. The Idaho Medical Cannabis Act did not qualify for the 2026 ballot. The Marijuana Policy Project reports the campaign verified 58,024 signatures against the 70,725 required, and notes that initiatives must also hold 6 percent of registered voters in 18 of Idaho's 35 legislative districts.16
What is HJR 4 and how could it change Idaho cannabis law?
HJR 4 is a constitutional amendment certified for the November 3, 2026 ballot, listed by the Secretary of State as the Grant Legislature Exclusive Authority and Prohibit Citizen-Initiated Measures on Marijuana, Narcotics, and Psychoactive Substances Amendment. It would leave the Legislature as the only route to legalization.15
Do Idaho hemp and CBD retailers need an ISDA license?
Possibly, and the answer is changing. Idaho Code 22-1705(4) now places establishments offering ingestible or inhalable hemp products under the Industrial Hemp Research and Development Act, and 22-1705(5) authorizes ISDA to set fees and penalties by rule. ISDA's published FAQ still states it is not requiring licenses for retailers. Confirm current requirements directly with ISDA.1
