The legislative record
2019
HB 171 signed March 6, 2019 as Chapter 173. It legalized hemp production and possession and repealed the 2015 supervised hemp extract sections at W.S. 35-7-1901 through 35-7-1903.8
2020
USDA accepted the Wyoming Department of Agriculture hemp regulatory plan on February 20, 2020. Final state hemp rules took effect August 13, 2020.3
2024
Senate File 32, Hemp limitations on psychoactive substances, signed March 7, 2024 as Chapter 56. Effective July 1, 2024, it barred synthetic substances and scheduled delta-8 THC.1
2025
The Tenth Circuit upheld Wyoming's hemp restrictions in Green Room LLC v. Wyoming, ruling the 2018 Farm Bill does not preempt the state ban.5
2025
Public Law 119-37, signed November 12, 2025, rewrote the federal hemp definition. Section 781 caps final consumer containers at 0.4 milligrams combined total THC.6
2026
HB 166, which would have reclassified marijuana as a Class III substance, was not considered for introduction on February 13, 2026 and died.1

Is marijuana legal in Wyoming in 2026?
No. Wyoming has no adult-use and no medical cannabis program, and marihuana remains a Schedule I controlled substance. Possession of three ounces or less in plant form is a misdemeanor punishable by up to 12 months in jail and a fine up to $1,000 under W.S. 35-7-1031(c).4
Does Wyoming have a medical marijuana card?
No. Wyoming issues no medical cannabis card and maintains no patient registry. State law also bars practitioners from prescribing marihuana or tetrahydrocannabinol unless the drug has final FDA approval, such as dronabinol. The 2015 supervised hemp extract sections were repealed by the 2019 hemp law.8
Is delta-8 THC legal in Wyoming?
No. Senate File 32, signed March 7, 2024 and effective July 1, 2024, added delta-8 tetrahydrocannabinol to Wyoming's Schedule I list and applied the 0.3 percent cap to psychoactive THC isomers. The Tenth Circuit upheld that ban in Green Room LLC v. Wyoming.1
What hemp and CBD products can Wyoming stores legally sell?
Wyoming stores may sell hemp and hemp products containing no synthetic substances and no more than 0.3 percent total THC on a dry weight basis. Because the statute specifies post-decarboxylation testing, THCA converts to THC in the measurement, so high-THCA flower does not qualify.1
Who regulates hemp in Wyoming?
The Wyoming Department of Agriculture licenses hemp production and processing and handles sampling, testing and disposal verification. USDA accepted the department's hemp plan on February 20, 2020. Separately, the Wyoming Attorney General serves as commissioner of drugs and substances control for scheduling decisions.3
