The legislative record
2018
Senate Bill 282 removes cannabidiol from the Kansas criminal definition of marijuana, but only for products containing no THC.10
2019
Governor Laura Kelly signs SB 28, Claire and Lola's Law, creating an affirmative defense for possessing CBD oil with up to 5 percent THC. It authorizes no in state supply.1
2021
Attorney General Opinion 2021-4, issued December 2, holds delta-8 THC is a Schedule I substance unless it comes from industrial hemp in a lawful hemp product at no more than 0.3 percent total THC.4

The Kansas Attorney General and the KBI execute THC enforcement search warrants on smoke, vape and CBD shops across eight Kansas cities, later challenged in a federal lawsuit.8

Legislation watch
Nothing is pending. The 2025 to 2026 session closed with no cannabis bill advancing, and Kansas has no citizen ballot initiative process, so any change must come from the Legislature. Cannabis is a live issue in the 2026 governor's race.

Dead. Would have replaced criminal penalties for under one ounce with a 25 dollar civil infraction. No committee hearing was granted.1

Is marijuana legal in Kansas?
No. Kansas has no medical or adult-use cannabis program, and cannabis possession remains a criminal offense. The Legislature closed its 2025 to 2026 session without enacting reform. SB 294, the Kansas Medical Cannabis Act, died in the Senate Committee on Federal and State Affairs without a hearing.2
Is CBD legal in Kansas?
Yes, but only at zero THC. Senate Bill 282, enacted in 2018, removed cannabidiol from the Kansas criminal definition of marijuana only when the product contains no THC. Any measurable THC pushes a CBD product back under the state marijuana statute and hemp product rules.10
Is delta-8 THC legal in Kansas?
Only narrowly. Kansas Attorney General Opinion 2021-4, issued December 2, 2021, holds that delta-8 THC is a Schedule I controlled substance unless it is made from industrial hemp and contained in a lawful hemp product with no more than 0.3 percent total THC.4
Can Kansas stores sell hemp flower, hemp vapes or smokable hemp?
No. K.S.A. 2-3908 makes it unlawful to manufacture, market, sell or distribute cigarettes, cigars, chew or other smokeless material, teas, and liquids, solids or gases for vaporizing devices that contain industrial hemp. Hemp buds may only go to licensed producers or registered processors.5
Does Kansas issue medical marijuana cards or license dispensaries?
No. Kansas has no patient registry, no medical cannabis cards and no licensed dispensaries. The only related protection is Claire and Lola's Law, SB 28 of 2019, which gives an affirmative defense for possessing CBD oil with up to five percent THC but creates no legal in state supply.1
What changes for Kansas hemp retailers in November 2026?
Federal law tightens. Public Law 119-37, Section 781, redefines hemp using a total THC standard that includes THCA and caps finished hemp cannabinoid products at 0.4 milligrams of total THC per container. The change takes effect one year after the November 12, 2025 enactment.6
