The legislative record
2015
The Texas Compassionate Use Act (SB 339) creates TCUP and directs DPS to build a registry of prescribing physicians.1
2019
HB 1325 legalizes hemp at up to 0.3 percent delta-9 THC by dry weight, opening the state's consumable hemp retail market.10

Are there recreational dispensaries in San Antonio?
No. Texas allows only low-THC medical cannabis through the Compassionate Use Program, which the Department of Public Safety administers under Health and Safety Code Chapter 487. Patients need a prescription from a physician registered in the Compassionate Use Registry of Texas. There is no adult use retail market in San Antonio.1
How do licensed dispensaries actually serve San Antonio patients?
Through approved pickup locations and statewide delivery rather than storefronts. HB 46 added Health and Safety Code Section 487.1035, letting a licensee run satellite locations that securely store low-THC cannabis, and it grandfathered pickup points approved before September 1, 2025. San Antonio pickup sites sit on Austin Highway and Stone Oak Parkway.20
Is a new dispensary license coming to the San Antonio region?
Conditionally, yes. In its May 8, 2026 corrected tabulation, DPS listed Lone Star Bioscience, Inc for Public Health Region 8, the South Central region that includes Bexar County. DPS states conditional licenses do not permit cultivation, distribution or sales until final approval after further due diligence.5
Did San Antonio decriminalize marijuana at the city level?
No. San Antonio voters defeated Proposition A on May 6, 2023, with 101,590 votes against and 40,237 in favor, a 71.63 to 28.37 percent margin. The measure would have barred police from citing or arresting for certain misdemeanor possession offenses. State law still governs inside the city.23
Does Bexar County arrest for low level marijuana possession?
Not always. Bexar County runs a Cite and Release initiative with the San Antonio Police Department and the Sheriff's Office, issuing citations instead of on-scene arrests for some non-violent misdemeanors including marijuana possession. The District Attorney's office then decides whether to divert, reject or file each case.24
Do San Antonio smoke shops sell the same thing as a licensed dispensary?
No. Smoke shops and hemp retailers sell consumable hemp products regulated by the Department of State Health Services, which adopted emergency rules on October 2, 2025 barring sales to anyone under 21. Low-THC cannabis moves only through DPS licensed dispensing organizations to prescribed patients in the registry.22
