- Prohibition. No adult-use market and no operating medical program. Possession is a criminal offense, and Wisconsin has no citizen ballot initiative, so any change must come through the legislature.1

- Hemp and hemp-derived products, including CBD, delta-8 and hemp-derived delta-9 edibles and beverages, sold through CBD stores, smoke shops and vape shops. No state cannabis retail license exists.1

- No state cannabis regulator. The DATCP hemp program ended January 1, 2022 and Wisconsin hemp growers are now USDA-licensed. The DATCP Bureau of Weights and Measures publishes method-of-sale and labeling guidance for hemp flower and CBD products.1

How it got here
The legislative record
2014
2013 Wisconsin Act 267 exempts CBD without psychoactive effect from THC penalties for seizure disorders. The dispensing it permits turns on a federal FDA investigational drug permit, so no in-state source opened.6
2017
2017 Wisconsin Act 4 broadens the CBD possession exemption to any medical condition with a physician certification, and extends board-approved dispensing to any medical condition on the same federal contingency.7
2019
2019 Wisconsin Act 68 conforms the state hemp definition in Wis. Stat. 94.55 to the 2018 Farm Bill, exempting hemp at 0.3 percent delta-9 THC or less from state controlled substances law.8
2025
Congress enacts P.L. 119-37. Section 781 narrows the federal hemp definition to total THC and adds a 0.4 mg per container cap, effective one year later.13
2026
Effective April 28, DOJ places marijuana in Schedule III only for FDA-approved drug products and marijuana under a state medical license. Wisconsin has no state medical program, so no Wisconsin-licensed product qualifies.10

Legislation watch
The 2025-26 session adjourned in March 2026 with every cannabis and hemp bill dead. Wisconsin has no ballot initiative, so change waits on the legislature seated in January 2027. Two federal events land sooner: the November 12 hemp cutoff and a pending DEA rescheduling decision.
Federal hemp redefinition, P.L. 119-37 Section 781
Enacted November 12, 2025. Takes effect November 12, 2026. Narrows hemp to 0.3 percent total THC and caps final products at 0.4 mg per container.13
Broader marijuana rescheduling, DEA Docket No. DEA-1362
On April 28, 2026 DEA withdrew the 2024 notice of hearing (89 FR 70148) and terminated those proceedings, and the same day noticed a new hearing beginning June 29, 2026 on moving all marijuana to Schedule III. No final rule has issued. Wisconsin has no state medical program, so rescheduling alone would not open cannabis retail here.11
H.R. 7010, two-year delay of the hemp redefinition
Introduced January 12, 2026. Referred to the House Subcommittee on Forestry and Horticulture in May 2026. Not enacted as of July 2026.14
SB 534, medical cannabis program
Recommended for passage by the Senate Committee on Health 4-1 on February 5, 2026. Never got a floor vote. Failed to pass March 23, 2026.2
SB 682 and AB 747, hemp-derived cannabinoid regulation
Neither bill passed. Wisconsin still has no state age limit, independent lab testing requirement or retail license for hemp THC products, and industry compliance is voluntary. SB 682 would have set an age-21 sales limit, required independent lab testing and mandated child-resistant packaging.19

Are there cannabis dispensaries in Madison, Wisconsin?
No. Wisconsin licenses no cannabis dispensaries and runs no comprehensive medical program, so Madison has none. What Madison does have is hemp and CBD retail: CBD stores, hemp THC shops, smoke shops and vape shops. Any Madison business calling itself a dispensary is selling hemp-derived products, not state-licensed cannabis.28
Is marijuana decriminalized in Madison?
Yes, at the city level. Madison's Common Council repealed and recreated Madison General Ordinance 23.20 in November 2020, allowing possession of up to 28 grams on public or private property with the property owner's permission and cutting the forfeiture to $1. State law still treats possession as a crime.26
Do Madison stores have to card for delta-8 and hemp THC?
Yes. Madison General Ordinance 23.202, enacted December 3, 2025, bars selling hemp-derived THC products to anyone under 21. A person, not an automated system, must verify a valid government or Tribal photo ID. Products must sit behind the sales counter and carry posted age signage.23
Can a new hemp THC shop open anywhere in Madison?
No. Madison General Ordinance 23.202 keeps establishments selling hemp-derived cannabinoids at least a quarter mile, or 1,320 feet, from youth-serving locations such as childcare centers, schools, playgrounds and city or county parks. Businesses already selling those products before January 1, 2026 are exempt from the distance rule.23
Where are Madison's main retail corridors for CBD and smoke shops?
Madison's retail spines are the isthmus corridors: State Street and Capitol Square, Williamson Street in the Marquette neighborhood, East Washington Avenue, Monroe Street, University Avenue and South Park Street. Suburban demand runs through Middleton, Fitchburg, Verona, Sun Prairie and Monona in Dane County.30
Who enforces Madison's hemp THC rules?
Public Health Madison and Dane County and the Madison Police Department. Ordinance 23.202 names the Director of Public Health Madison and Dane County or a designee, along with the police, as enforcement officials. The Board of Health for Madison and Dane County requested the ordinance, which the Common Council passed November 25, 2025.23
