Full prohibition. No adult-use market and no medical cannabis program. Marijuana and tetrahydrocannabinols are Schedule I substances under Idaho Code 37-2705, and possession, delivery and manufacture are criminalized under Idaho Code 37-2732.1

Idaho Code 22-1705(4) ties retail products for ingestion or inhalation to the criteria in 37-2701(u), while ISDA guidance still states 0 percent THC at distribution. High THCA flower fails the total THC test, and delta-8 remains exposed under Idaho's Schedule I tetrahydrocannabinols listing.1
Governing body
The Idaho State Department of Agriculture regulates hemp. Idaho Code 22-1705(4) now places establishments offering ingestible or inhalable hemp products under Title 22, Chapter 17, and 22-1705(5) authorizes ISDA to set fees and penalties by rule. Idaho has no cannabis regulator because it has no cannabis program.1

THC rule
Three layers apply. Handling facilities may obtain hemp from a producer at up to 0.3 percent THC. ISDA guidance states manufactured hemp products must be at 0 percent THC at the point of distribution. Since July 1, 2026, Idaho Code 22-1705(4) requires retail hemp products for ingestion or inhalation to meet 37-2701(u), which sets 0.3 percent total delta-9 THC including THCA.1

  1. 2015

    Governor Otter vetoes SB 1146, a bill that would have allowed CBD oil for children with intractable epilepsy, and instead authorizes a limited Epidiolex expanded access study.22

  2. 2021

    Governor Little signs House Bill 126 on April 16, legalizing industrial hemp production, processing and transport in Idaho.13

  3. 2025

    House Bill 7 is signed, adding a mandatory minimum fine for possessing three ounces or less of marijuana. It takes full force and effect on July 1, 2025.11

  4. 2025

    The Legislature adopts HJR 4, the House 58-10-2 on March 5 and the Senate 29-6-0 on March 11, sending voters a constitutional amendment that would give lawmakers sole authority to legalize marijuana and other psychoactive substances.14

    House Bill 879 is signed April 2 and takes effect July 1, adding Idaho Code 22-1705(4), which subjects establishments offering hemp products for human ingestion or inhalation to the Industrial Hemp Research and Development Act and requires those products to meet the criteria of 37-2701(u) and 37-2705(d)(29)(i).7

    The Idaho Medical Cannabis Act falls short of the 2026 ballot. The Marijuana Policy Project reports the campaign verified 58,024 signatures against the 70,725 required.16

Nothing pending would open an Idaho dispensary market. The live questions are HJR 4 on the November 3, 2026 ballot, which would close the citizen initiative route, and how ISDA reconciles its 0 percent guidance with HB 879. The federal hemp redefinition takes effect November 12, 2026.

    Certified for the November 3, 2026 ballot as the Grant Legislature Exclusive Authority and Prohibit Citizen-Initiated Measures on Marijuana, Narcotics, and Psychoactive Substances Amendment.15

  • HB 879, sale of hemp products for human ingestion or inhalation

    Signed April 2, 2026, effective July 1, 2026, Session Law Chapter 292. Passed the House 53-16-1 and the Senate 24-10-1. It added Idaho Code 22-1705(4), requiring such products to meet the criteria of Idaho Code 37-2701(u) and 37-2705(d)(29)(i) and subjecting those establishments to Title 22, Chapter 17.7

  • HB 772 negligent violation standard for hemp producers

    Signed April 2, 2026, effective July 1, 2026, Session Law Chapter 293. Amends existing law to provide for negligent violations by licensed hemp producers.8

  • Federal hemp redefinition, Public Law 119-37

    Enacted November 12, 2025 and effective one year later, on November 12, 2026. It measures hemp on total THC including THCA, cuts off finished products above 0.4 milligrams total THC per container, and excludes synthesized cannabinoids.20

Can a cannabis dispensary operate in Boise, Idaho?

No. Idaho has no medical or adult-use cannabis program, and marijuana remains a Schedule I controlled substance under state law, so no licensed dispensary can operate in Boise. The compliant retail segment in the Treasure Valley is CBD stores, hemp retailers, smoke shops and vape shops.24

Does Boise require its own license for a vape or smoke shop?

No. Idaho Code 39-5713 prohibits any local government from adopting tobacco or electronic smoking device rules more restrictive than state law, and bars local taxes or fees on those products. A single state permit issued under Idaho Code 39-5704 covers each Boise business location.26

What does Idaho law say about CBD sold in Boise stores?

Idaho Code 37-2701 excludes from the definition of marijuana only licensed hemp at or below 0.3 percent total delta-9 THC, plus mature stalks, sterilized seed and seed oil, but not the resin. Material with THC outside those carve-outs is presumed marijuana, so product claims need care.25

Can Boise still restrict where a smoke shop opens?

Yes. Idaho Code 39-5713 preserves local zoning and land use authority even though it preempts local tobacco licensing and taxes. Boise regulates location through Title 11, its Development Code, whose current version took effect in April 2026 under Ordinance 25-25, so siting remains a local question.28
