Legal status: Prohibited. Idaho Code 37-2705 lists marijuana in Schedule I, along with tetrahydrocannabinols other than the amount permitted in industrial hemp. The Idaho Office of Drug Policy states that the use and sale of marijuana for any purpose is illegal in Idaho, with penalties in Idaho Code 37-2732 and 37-2732C.6
What may be sold at retail: CBD and other hemp products, within narrow limits. The Office of Drug Policy says CBD oil is legal only when processed from industrial hemp and containing no THC at all, and ISDA's hemp FAQ says CBD must have zero percent THC in Idaho. Since July 1, 2026, Idaho Code 22-1705(4) has required hemp products for ingestion or inhalation, other than nonviable hulled hemp seed, hemp seed protein powder or hemp seed oil, to meet the criteria in 37-2701(u) and 37-2705(d)(29)(i).19
Governing body: The Idaho State Department of Agriculture (ISDA) licenses and regulates the production, processing, transportation and research of industrial hemp. HB 879 made establishments offering covered hemp products for ingestion or inhalation, which excludes nonviable hulled hemp seed, hemp seed protein powder and hemp seed oil, subject to the same act, and ISDA has proposed a retailer license under it. There is no cannabis regulator because marijuana sale is illegal.13
Program: No state cannabis program. Hemp is governed by the Industrial Hemp Research and Development Act, Idaho Code Title 22, Chapter 17.8
In effect since: 2021 for industrial hemp, under HB 126, effective April 16, 2021. The hemp retail provision added by HB 879 took effect July 1, 2026.11
THC rule: Idaho's sources separate hemp inputs from finished products. Idaho Code 37-2701(u) defines hemp as not more than 0.3 percent total delta-9 THC, counting THCA, and ISDA's hemp FAQ says handling facilities may obtain hemp from a producer with up to 0.3 percent THC. That FAQ also says all manufactured hemp products must be at 0 percent THC at the point of distribution. ISDA's proposed rule would define a prohibited cannabis product as any product containing THC, except biomass under a producer license.5

Idaho CBD and hemp rules for marketing and sale: what the sources say

We read HB 879, Idaho Code 37-2701 and 39-5704, ISDA's hemp FAQ and proposed hemp rule, and the Office of Drug Policy's CBD guidance for provisions on marketing, labelling and sale. These are the ones that reach an Idaho store's pages, listings and shelves.

HB 879 added Idaho Code 22-1705(4): establishments offering hemp products intended for human ingestion or inhalation, other than nonviable hulled hemp seed, hemp seed protein powder or hemp seed oil, are subject to the Industrial Hemp Research and Development Act, and those products must meet the criteria in Idaho Code 37-2701(u) and 37-2705(d)(29)(i).1
Under the same section, renumbered by HB 879, ISDA may set fees and penalties by rule, and no penalty may be imposed unless the person had notice and an opportunity for a hearing under the Idaho Administrative Procedure Act.1
ISDA's proposed rule would treat online, digital and mobile sellers as retailers and require a license for each location or site. It defines a prohibited cannabis product as any product containing THC, other than producer biomass, and states that offering one for sale remains unlawful.15
ISDA's hemp FAQ says ISDA is not requiring licenses for retailers and that CBD must have zero percent THC in Idaho.14
The Office of Drug Policy notes that the FDA has sent warning letters to firms marketing unapproved new drugs, after unsupported health claims for CBD products.19
Smoke and vape shops need a state permit under Idaho Code 39-5704 to sell or offer tobacco products or electronic smoking devices at retail, with a separate permit for each place of business.9

What happens next

Legislation watch

The only cannabis measure on Idaho's November 3, 2026 ballot is HJR 4, which would leave legalization to the Legislature alone, and both 2026 cannabis initiatives failed to qualify. For retailers, the live question is ISDA's proposed hemp retailer rule. The federal hemp redefinition has its application limited until December 11, 2026 by Public Law 119-103.

Federal hemp redefinition, Public Law 119-37
Enacted November 12, 2025. Public Law 119-103 limits its application until December 11, 2026 to products with cannabinoids not capable of being naturally produced by the plant. It measures hemp on total THC including THCA, excludes final hemp-derived cannabinoid products with more than 0.4 milligrams combined per container of total THC (including THCA) and THC-like cannabinoids, and excludes synthesized cannabinoids.22

Does Boise require its own tobacco or vape retail license?

The state permit under Idaho Code 39-5704 is the only retail tobacco product or electronic smoking device permit or license required, and each Boise place of business needs its own. Zoning authority is preserved.23

Can Boise restrict where a smoke shop or CBD store opens?

Yes. Idaho Code 39-5713 preserves local zoning and land use authority even though it preempts local tobacco licensing and taxes. Boise regulates location through Title 11, its Development Code, whose updated version took effect in April 2026 under Ordinance 25-25, so siting remains a question for the city.24

Is marijuana legal in Idaho in 2026?

No. The Office of Drug Policy says the use and sale of marijuana for any purpose is illegal in Idaho. Under Idaho Code 37-2732(e), possessing three ounces or less is a misdemeanor with a minimum 300 dollar fine from age 18, in addition to possible penalties of up to a year in jail; more than three ounces is a felony.7

Is CBD legal to sell in Idaho?

Yes, narrowly. The Office of Drug Policy says CBD oil is legal only when made from industrial hemp with no THC at all, and ISDA's hemp FAQ says CBD must have zero percent THC. ISDA's July 28, 2026 rulemaking minutes record its director clarifying that HB 772 and HB 879 do not change which hemp products are legal.19

Are delta-8, THCA flower or hemp THC drinks legal in Idaho?

Not under Idaho's official guidance. ISDA's proposed hemp rule defines any product containing THC, other than producer biomass, as a prohibited cannabis product, and the Office of Drug Policy says products found in Idaho retail must contain zero percent THC. Idaho Code 37-2701(u) also counts THCA toward the 0.3 percent total delta-9 THC limit in its hemp definition.15
