The legislative record
2015
The Texas Compassionate Use Act (SB 339) creates TCUP and directs DPS to build a registry of prescribing physicians.1
2019
HB 1325 legalizes hemp at up to 0.3 percent delta-9 THC by dry weight, opening the state's consumable hemp retail market.10

Governor Abbott vetoes SB 3 on June 22, the bill that would have banned consumable hemp THC products at retail.7

Are there recreational cannabis dispensaries in Houston?
No. Texas allows only prescription low-THC cannabis through the Compassionate Use Program, administered by the Department of Public Safety. Houston has no adult-use retail. Businesses marketing themselves as a Houston dispensary are usually hemp or CBD shops, which is a different regulatory category and a different search landscape.1
Which licensed dispensing organizations serve the Houston area?
The Texas DPS licensed dispensary roster, last updated December 5, 2025, lists three active licensees: Fluent, Texas Original and goodblend. Each publishes Houston-area pickup points, and Texas Original and goodblend also list delivery covering the Houston metro. DPS is the authoritative roster, not third-party directories.4
Can a licensed dispensary open a pickup location in Houston?
HB 46 authorizes satellite locations in addition to a licensee's primary location, subject to DPS approval within 180 days of application. A dispensing organization may not operate more than one satellite location in a public health region until it operates one in each region. Houston is in Region 6/5S.20
How many dispensing organization licenses will Texas issue, and by when?
HB 46 directs DPS to issue 15 dispensing organization licenses statewide, with at least nine new organizations licensed by December 1, 2025 and at least three more by April 1, 2026. That expansion determines how much prescription pickup capacity eventually reaches the Houston metro.20
What changed for Texas medical cannabis in 2025?
Governor Abbott signed HB 46 on June 20, 2025, effective September 1, 2025. It expanded qualifying conditions to include chronic pain, traumatic brain injury, Crohn's disease and other inflammatory bowel disease, and terminal or hospice care, and raised the licensee cap from three to fifteen.22
