How it got here

The legislative record

2015
The Texas Compassionate Use Act (Senate Bill 339) is enacted, and DPS is required to create a secure registry of physicians.1

The Governor vetoes SB 3, the bill regulating hemp-derived products, on June 22. The bill history shows no later action.8

HB 46 is signed on June 20 and takes effect September 1. It sets the 10 milligram dosage unit limit, lists the qualifying conditions, allows satellite locations and requires 15 TCUP licenses.7

DPS announces Phase II of the TCUP expansion on April 1 and conditionally awards three more licenses after nine in Phase I. A conditional license does not authorize sales until DPS gives final approval.3

Proposition A, the Houston Freedom Act, is on the ballot in the City of Houston's November 3, 2026 charter amendment election, and as of October 29, 2026 voters have not decided it. The proposed amendment would require the Houston Police Department to make enforcement of Class A and Class B misdemeanor marijuana possession its lowest law-enforcement priority, with reporting requirements, and would prohibit Houston police officers from requesting or executing no-knock search warrants. None of its eleven sections addresses retail sales.16

We do not assume how Houston searches. We start from the business's own Search Console queries and an intent-segmented keyword set, then test City of Houston Super Neighborhood names as modifiers. The City publishes its election notice in English, Spanish, Vietnamese and Chinese, so we check demand in those languages too, and build a page only where demand is verified.

Advertising rules

Texas cannabis advertising rules: what the sources say

We read the HB 46 enrolled text and the DSHS Consumable Hemp Program pages for advertising provisions. This is what they contain and what they do not.

HB 46's enrolled text contains no advertising provision. It does cover satellite locations and licensing.6
DSHS states an age gate, not an advertising rule. Sellers must verify each purchaser is 21 or older, and emergency rules 300.701 and 300.702 require valid government-issued identification.9
Consumable hemp products must be properly tested, packaged and labeled under Health and Safety Code chapter 443 and 25 Texas Administrative Code chapter 300, so page claims should match the label.10
The State Law Library reports that retailers who make, sell or distribute authorized consumable hemp products must register or obtain a license, and that state rules bar sales to anyone under 21.13

Legislation watch

Texas is moving on two fronts: DPS is finishing the TCUP expansion, and the definition of hemp is tightening. We list only items with a primary source.

TCUP expansion, 12 additional licenses
DPS announced conditional awards in two phases, the second on April 1, 2026. Final approval is needed before sales, DPS invoices fees only after due diligence is passed, and licensees must be fully operational within 24 months. Final approvals after April 2026 were not checked.3

Section 781 redefines hemp at 0.3 percent total THC including THCA on a dry weight basis and excludes final hemp-derived cannabinoid products with more than 0.4 milligrams combined per container of total THC (including THCA) and THC-like cannabinoids. What is Houston Proposition A?

Proposition A, the Houston Freedom Act, is a proposed charter amendment on Houston's November 3, 2026 ballot; voters have not yet decided it. Does Harris County divert misdemeanor marijuana cases?

Yes, through the District Attorney's Misdemeanor Marijuana Diversion Program, a pre-charge program run with local law enforcement. Eligible adults 17 or older detained for Class A or B marijuana possession complete an online education program, and those who finish have no record of an arrest or charge for possession. People on felony probation or deferred adjudication are not eligible.17

Which new medical cannabis licensees are assigned to the Houston region?

Harris, Fort Bend and Montgomery counties fall in Public Health Region 6. DPS's corrected tabulation of May 8, 2026 names two conditional licensees there, Bluebonnet Technologies, LLC and PC TX OPCO LLC dba PharmaCann. DPS says a conditional license does not allow cultivation, manufacture, distribution or sale until the department gives final approval.20

Is cannabis legal in Texas?

Recreational use of marijuana is still illegal under Texas and federal law, according to the Texas State Law Library. The lawful channels are the Compassionate Use Program, where DPS-licensed organizations dispense low-THC cannabis of no more than 10 milligrams of THC per dosage unit, and DSHS-regulated consumable hemp.12

What are the Texas Compassionate Use Program qualifying conditions?

HB 46 lists epilepsy, a seizure disorder, multiple sclerosis, spasticity, ALS, autism, cancer, an incurable neurodegenerative disease, PTSD, a condition that causes chronic pain as the statute defines it, traumatic brain injury, Crohn's disease or other inflammatory bowel disease, a terminal illness or hospice or palliative care, or a condition approved for a research program for which the patient is receiving treatment under that program. The patient must be a permanent resident of Texas, and the physician must determine the risk is reasonable in light of the potential benefit.6

How many TCUP dispensing licenses are there?

HB 46 requires DPS to issue 15 licenses in total. DPS's published directory, dated December 5, 2025, lists three active licensees: Fluent, Texas Original and Goodblend. DPS announced conditional awards for 12 more in two phases, the second on April 1, 2026, and a conditional license does not authorize sales until DPS gives final approval.2
