Introduction

Michigan cannabis advertising is governed by Mich Admin Code R 420.507, effective Mar. 7, 2022, and enforced by the Cannabis Regulatory Agency. Per the rule, ads may not mislead, make health claims unless FDA-authorized, or target anyone under 21, and the advertiser needs reliable evidence that no more than 30% of the audience is expected to be under 21. Every ad must call the product "marihuana" for adults 21 and older and carry the R 420.504(1)(j) warnings.

This page is general information sourced from the rule text, not legal advice. Confirm anything you plan to publish with the CRA or your own counsel.

Section 01

Who regulates Michigan cannabis advertising and which rule governs it

The Cannabis Regulatory Agency is Michigan's regulator for adult-use marijuana. Its advertising rule, R 420.507, sits in the CRA's consolidated marihuana rules PDF, and its history line reads "2020 AACS; 2022 MR 5, Eff. Mar. 7, 2022."

Every quotation in the table was checked against that PDF on Oct. 13, 2026.

RequirementWhat R 420.507 says
Local law and signsA product "may only be advertised or marketed in compliance with all applicable municipal ordinances, state law, and these rules that regulate signs and advertising."
Truthfulness"A licensee may not advertise a marihuana product in a way that is deceptive, false, or misleading"
Health claimsMarketing and advertising "must not contain any claim related to health or health benefits" unless the FDA has authorized the claim
AudienceAn ad may run only if the advertiser "has reliable evidence that no more than 30% of the audience or readership" is reasonably expected to be under the age listed (21 for adult use, per the rule)
Under-21 marketingAdult-use products "must not be marketed or advertised to individuals under 21 years of age."
Sponsorships"Sponsorships targeting individuals under 21 years of age are prohibited."
Product wordingAdult-use products "must be marketed or advertised as 'marihuana' for use only by individuals 21 years of age or older."
WarningsAny advertised or marketed product "must include the warnings listed in R 420.504(1)(j)."
Section 02

Who your ads can reach: the 30 percent audience test and the under-21 ban

The audience test checks the placement, not the message. It names the television program, radio program, internet website and print publication, so a website, your own included, falls inside it.

The rule asks for reliable evidence without saying what counts. Before you buy a placement, get the seller's audience data in writing and ask the CRA what it accepts.

Two separate bans sit beside the 30 percent test. Marketing to people under 21 is prohibited, and so is any sponsorship that targets them.

Section 03

What every Michigan ad must say and the warnings it must carry

Note the h. The required word is "marihuana," paired with the statement that the product is for adults 21 and older, and both belong in every ad.

The R 420.504(1)(j) warning set includes these four statements:

  • "It is illegal to drive a motor vehicle while under the influence of marihuana."
  • "National Poison Control Center 1-800-222-1222."
  • "For use by individuals 21 years of age or older or registered qualifying patients only. Keep out of reach of children."
  • A boxed warning: "WARNING: USE BY PREGNANT OR BREASTFEEDING WOMEN, OR BY WOMEN PLANNING TO BECOME PREGNANT, MAY RESULT IN FETAL INJURY, PRETERM BIRTH, LOW BIRTH WEIGHT, OR DEVELOPMENTAL PROBLEMS FOR THE CHILD."

The Cornell LII copy of the rule cites the warning paragraph as (k). The CRA's own PDF cites (j), so cite the CRA version in your compliance notes.

Section 04

Claims Michigan advertising cannot make

The health-claim line covers marketing as well as advertising, so hold your own copy to it, not only paid ads. Describe what a product is, such as its format and strain name, and leave out anything it is said to do for a condition.

The truthfulness line reaches offers too. A price or deal in an ad should match what the store will honor at the counter.

Section 05

Signs, outdoor ads and local ordinances

R 420.507 handles outdoor advertising by reference: a product may be advertised only in compliance with municipal ordinances, state law and the CRA's sign rules. That makes the city or township where a sign would stand the second authority to check, after the CRA.

Section 06

How R 420.507 applies to a dispensary website

Because the audience test names "internet website," a dispensary site sits inside R 420.507, not beside it. Three points follow.

  1. 1Audience. Keep reliable evidence of who reads your site, ready to show.
  2. 2Product pages. Pages that market specific products are the first place to check for the "marihuana" wording and the warnings. Put the warnings in page text rather than inside an image, so visitors and search crawlers can both read them.
  3. 3Content. Learn articles, product descriptions and meta descriptions follow the same no-health-claims line as ads.
Section 07

What to confirm with the CRA before you publish

R 420.507 does not mention billboards, loyalty programs, coupons, discounts, giveaways, age verification, social media or email. Ask the CRA about these before you publish rather than guess:

  • The complete R 420.504(1)(j) warning set, beyond the four statements quoted above.
  • Any billboard or outdoor placement rule outside R 420.507, plus your municipality's sign ordinance.
  • Whether loyalty programs, discounts, coupons or giveaways carry terms of their own. Any promotion still has to be truthful and may not target anyone under 21.
  • Whether, and how, a website must verify age.
  • How the rules apply to social media, email, SMS and paid digital placements.
